PRIVACY POLICY

  • I. Introduction

Roxy Trading Inc. (“Roxy,” “we” or “us”) offers Chimes brand of natural food products for direct sale to consumers on its website, www.chimesgourmet.com (“Chimes Website”).  This privacy notice aims to inform you about how we collect, use, disclose and store information about you when you use various features on the Chimes Website. We also try to make it as simple as possible for you to control the information you share through the Chimes Website – whether such information is kept private, becomes publicly available by search engine index, is shared with some of our third party service providers or gets permanently deleted.

  • II. What Information Do We Collect Through The Chimes Website? We only collect information about users of the Chimes Website if we have a reason to do so.  For example, we collect information that is necessary to process your purchases, to ship the products you purchased from us, to communicate with you about our products and services, or to improve our services to you.  Consequently, we collect information from the three following sources: (1) Information you provide to us; (2) Information we collect automatically through cookies; and (3) Information collected from third parties such as service providers we use or through social networking sites.
    1. Information Users Directly Submitted to Us:
      • If you contact us through the Chimes Website, we will keep a record of our correspondence.
      • Personal InformationWe gather various types of information, including information that identifies or may identify you as an individual (“Personal Information”).  We collect Personal Information, such as name and email address when you set up an account on the Chimes Website or subscribe to our newsletter.
      • Personal Information from Purchase Transactions: If you have purchased products through the Chimes webstore and have provided information necessary to ship the purchased products to you, then we would have received and stored your Personal Information such as names, usernames, email addresses, postal addresses, phone numbers and payment information.  
      • Other Information: In addition to Personal Information, if you have uploaded other information by submitting correspondence through the Chimes Website, we will maintain such information.  
    2. Information We Collect Automatically:
      • (a) Information Collected Through Cookies And Other Similar Technologies:  A cookie is a small amount of information that a web server sends to your Internet browser.  Generally, cookies are used to support the operation of a variety of features provided on a website.  For instance, on the Chimes Website, cookies are used to support a variety of webstore functions that allow you to purchase items featured on the website.  The Chimes Website also uses cookies to collect information about how you interacted with our website. This allows us to remember you and your preferences.  For example, by continuing to browse the site, you are agreeing to our use of cookies.       • Usage information:  We keep track of activities on the Chimes Website from users, how users interact with the website and our website’s performance.
      • Log information:  We log information about our visitors use of the Chimes Website.  As indicated in our Cookie Policy, we use Google Analytics which logs information about how many people are viewing the pages, usage statistics, and error messages.  The log information includes collection of Internet Protocol (“IP”) addresses from users. Since we utilize WooCommerce to provide e-commerce services, WooCommerce Usage Tracker technology may track your information about the location of your IP addresses to provide information about the location of our customers.
    3. Information We Collect About You from Third Parties: We may also receive information about you from third parties that provide necessary services such as payment processing and shipping services.  For example, we utilize WooCommerce, an e-commerce platform provided by WordPress, to process purchase transactions on the Chimes Website. Through the shopping cart in the Chimes webstore, we offer our customers the option to checkout with PayPal or through Stripe, a payment service provided by WooCommerce.  Therefore, we may receive contact information such as your email address or phone number associated with PayPal or Stripe. Furthermore, shipping services provided by USPS and FedEx/DHL may provide us with updated or corrected delivery addresses for customer purchases.  In addition, if you log in to the Chimes Website through your Facebook account or have linked your Chimes account with your Google or Facebook accounts, Roxy may receive information from that service (such as your username and friends list, etc.) as a result of the authorization procedures for that service.  These are just some examples of many ways that your Personal Information may automatically be transmitted to us by third parties over the Internet.
  • III. How We Use and Share The Information Collected Through The Chimes Website  
    • 1. How Roxy Uses Your Information:  We may use the information collected from visitors to our website for a variety of purposes, including to:
      1. Set up a user account;
      2. Process and complete purchase transactions;
      3. Provide, operate and maintain webstore services;
      4. Respond to inquiries and comments and provide customer service and support;
      5. Send alerts and security notifications; and 
      6. Investigate and prevent fraudulent activities such as unauthorized access to the Chimes Website.
    • 2. Third Parties With Whom We May Share Your Information We may share your information with third party vendors, consultants and other service providers who perform necessary services for the Chimes webstore.  Third parties that provide necessary services include, for example, our e-commerce provider, WooCommerce, payment processing providers such as Stripe and PayPal, the U.S. Postal Service, FedEx and UPS (just to name a few) that provide shipping services, email service providers (e.g., The Rocket Science Group, LLC which provides Mailchimp services) and Internet service providers.  Roxy does not sell personal information collected through the Chimes Website in exchange for any monetary consideration.  However, if we were to share your personal information with third parties (through the use of cookies and similar technologies) that provide useful services which are not considered “essential,” such sharing could be deemed a “sale,” as defined by the California Consumer Privacy Act (Cal. Civ. Code 1798.140(t)(1)).  This includes sharing identifiers, commercial information and Internet or other electronic network activity with website analytics companies such as Google and Facebook that provide pixel tools which help us provide the kinds of products and marketing on our website that our customers want to see on the Chimes Website.  
    • 3. Third Parties’ Cookies, Technologies and Privacy Policies The third parties that provide necessary services for the Chimes webstore set cookies and similar technologies on the Chimes Website.  Consequently, interacting with third party software means that you are providing information about yourself to those third parties. For example, some third-party services may request or require access to your data via cookie/pixel.  Please note that if you use a third-party’s service or grant access, your data will be handled in accordance with that third party’s privacy policies and practices.  On the Chimes Website, we utilize the WooCommerce system to provide webstore services for our customers.  Automattic Inc. owns WooCommerce and operates WordPress. WooCommerce is WordPress’ e-commerce platform. As a result, even though Roxy uses WooCommerce’s software primarily to provide the webstore services on the Chimes Website, Roxy does not own or control the software or technology associated with WooCommerce or any WordPress software associated with Automattic Inc.  Therefore, when you browse and purchase products featured on the Chimes Website, you would be using the software of third parties such as Automattic, Stripe (which provides WooCommerce Payments) and PayPal. These platforms have their own rules about information collection, use, and sharing. Therefore, when you purchase products through the Chimes Website, the following privacy policies may apply to you and you should review them before using their software or services:

  • IV. Security Presently, there is no company or service can guarantee complete security. Unauthorized entry or use, hardware or software failure, and other factors, may compromise the security of user information at any time.  However, we take reasonable measures to protect information about you. If you have opened an account with us, your account is protected by a password for your privacy and security. You must prevent unauthorized access to your account and Personal Information by selecting and protecting your password appropriately and limiting access to your computer or device and browser by signing off after you have finished accessing your account.
  • V. Your Rights Regarding Your Personal Information You can exercise your rights regarding your Personal Information collected through the Chimes Website easily in several ways: 
    • 1. EU General Data Protection Regulation As of the date of this Privacy Notice (“Notice”) we do not offer any products of services outside of the U.S.  Even so, in the event that any resident of the European Union has submitted his or her Personal Information through our website where such information was captured and shared with third parties through cookies or similar technologies used on the Chimes Website, we have provided options below to access, review, update, rectify, and delete any Personal Information we hold about you, or exercise any other right available to you under the EU General Data Protection Regulation (GDPR).  
        1. Forget me/Opt-out Form: To request that we delete all the information we collected about you through the Chimes Website please complete and submit the form available here.  Please note that we may still use any aggregated and de-identified Personal Information that does not identify any individual and may also retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.
        2. Rectify My Info Form:  You can also correct/revise the Personal Information you submitted to us by completing and submitting the form available here.
        3. Review/Access Your Personal Information:  To request access to any Personal Information we have retained or collected about you, please send the request to: [email protected].  
        4. To Opt-Out of Cookies: With respect to cookies, you can customize your settings at any time by clicking on the “inspector” icon which appears on the lower right corner of each webpage on the Chimes Website and which is shown immediately below:  When you click on the “inspector” icon, it opens a “Privacy Settings” dialog box, which is illustrated immediately below.  The categories of cookies the Chimes Website typically deploys during a browsing session are listed on the left side of the box.  The Privacy Settings box provides you with the option to allow or disable cookies under each category.  Alternatively, you can opt out of the cookies set by Google on this website.  Google offers an opt-out mechanism for the web available here. https://tools.google.com/dlpage/gaoptout/
    • 2. California Residents California residents have specific rights under the California Consumer Privacy Act (‘CCPA’).  As of the date of this Privacy Notice (“Notice”), Roxy is not obligated to comply with the CCPA with respect to its Chimes Website.  However, we support the CCPA and have provided the following means to exercise control over your Personal Information we have collected:   
      • Delete Your Information:  If you would like to exercise your right to delete any Personal Information we have collected or received about you, please fill out the request form available through this link.
      • To Opt-Out:  Roxy does not sell Personal Information collected through the Chimes Website in exchange for any monetary consideration.  However, if we were to share your Personal Information with third parties (through the use of cookies and/or similar technologies), you can opt-out of the use of cookies by clicking on the “inspector” icon which appears on lower right corner of each webpage on the Chimes Website.  This brings up a “Privacy Settings” dialog box.  The categories of cookies the Chimes Website typically deploys during a browsing session are listed on the left side of the box.  The Privacy Settings box provides you with the option to allow or disable cookies under each category. Illustrations of the “inspector” icon and the Privacy Settings dialogue box are provided above in Section V, Paragraph 1, sub-paragraph d.   
        1. California and Delaware “Do Not Track” Disclosures:  California and Delaware law require Roxy to indicate whether it honors “Do Not Track” settings in your browser concerning targeted advertising.  Roxy adheres to the standards set out in this Privacy Notice and does not monitor or respond to Do Not Track browser requests.
        2. The Right to Non-Discrimination:  Roxy will not discriminate against you (such as by denying goods or providing a different level or quality of goods or services) for exercising any of the rights available to you.
        3. Children:  We do not knowingly collect or solicit personal information from anyone under the age of 13.  If you are under 13, please do not attempt to set up an account on the Chimes Website or send any Personal Information about yourself to us.  If we discover that we have collected Personal Information from a child under age 13, we will delete that information as quickly as possible.         4. Linked Websites: For your convenience, we have provided some hyperlinks to other websites (the “Linked Sites”) in this Notice in Section III, Paragraph 3, sub-paragraphs 1) through 5).  This Notice does not apply to, and we are not responsible for, the privacy practices of any Linked Sites or of any companies that we do not own or control. Linked Sites may collect information in addition to that which we collect on the Chimes Website.  We do not endorse any of these Linked Sites, the services or products described or offered on such Linked Sites. We encourage you to seek out and read the privacy notice of each Linked Site.  
        5. Changes to the Privacy Notice: We’re constantly trying to improve our Websites and Services, so we may need to change this Privacy Notice from time to time as well.  We will alert you to material changes by, for example, placing a notice on our Websites and/or by sending you an email (if you have registered your e-mail details with us) when we are required to do so by applicable law.  You can see when this Privacy Notice was last updated by checking the date at the top of this page. You are responsible for periodically reviewing this Privacy Notice.
